Hi, my name is Scott Maasen with the Maasen Law Firm, and in this video I want to talk with you about aggravated DUI as a class 6 felony in Arizona, where it’s basically a DUI charge with a child in the car.
Aggravated DUI Child in Car is a Felony
The law in Arizona is if you have a child in the car under the age of 15, that’s a felony offense, as a class 6 felony. What would happen is you go to court and if you’re convicted of that charge you’d have a permanent felony on your record, you would receive a probation sentence, or you could receive a prison sentence up to 1 year. What we like to do at these cases, have people understand what their rights are and what their options are, and often times these cases can be reduced down or negotiated, or even dismissed if they’re handled properly.
