Hi. My name is Scott Maasen. Today in this video I’m going to talk to you about a DUI drug charge, specifically if it’s related to prescription drugs.
Arizona has some of the toughest DUI laws in the country as many of you know. One of the charges is called an A3 charge, or a 28-1381A3 charge, a DUI drugs. Arizona’s a very unique state in the standpoint that even if you have a prescription drug and you’re prescribed the drug by your doctor and it’s all valid, you still can be charged with that offence in Arizona. One of the other ways they also charge it, if you don’t have a prescription and you have either a narcotic or any kind of illegal drug, but if it’s not authorized by a doctor, you can also be facing the same charge.
Many of our clients ask, “Well, how can I be charged with a drug charge if I have a prescription?” The answer is you can, but there are ways to defend that case because if you have a prescription and it’s valid and at certain levels, that’s a way it’s a defense to the case. DUI drug charges are very common. The police write a number of those tickets all the time. They’re something that really can be resolved and resolved favorably and be taken off your record.
